These Terms of Use (“terms”) govern your access to and use of the website at walkincheckin.com.au (the “site”), operated by CheckIn by WalkInCheckIn (“CheckIn”, “we”, “us” or “our”).
By accessing or using the site, you agree to these terms and to our Privacy Policy. If you do not agree, please do not use the site.
These terms cover this marketing and information website only. Your use of the CheckIn product itself is governed by the separate written agreement between your business and us. If there is any inconsistency between these terms and that agreement in relation to the product, the product agreement prevails.
You must be at least 18 years old to use the site. If you use the site on behalf of a business, you confirm that you are authorised to act for that business and to accept these terms on its behalf.
You may use the site for lawful purposes and to learn about our product. You must not:
The site and its content — including text, graphics, logos, images, layout, design, and the “CheckIn” name and branding — are owned by or licensed to us and are protected by intellectual property laws.
We grant you a limited, non-exclusive, non-transferable and revocable licence to access and view the site for your own internal and informational use. All other rights are reserved. You must not use our trade marks or branding without our prior written consent.
When you book a demo, request early access or submit an enquiry, you agree to provide accurate and complete information, and you consent to us contacting you about your request. Submitting an enquiry does not create a binding contract; any supply of the CheckIn product is subject to a separate agreement.
Information on the site is provided for general information only and may change without notice as we develop CheckIn. Some features may be described as upcoming or “coming soon” — these are not commitments to deliver on any particular timeframe. The site does not constitute professional, legal or financial advice, and you should not rely on it as such.
The site may contain links to third-party websites and services that we do not control. We provide these links for convenience only and are not responsible for the content, products or practices of those third parties. Your dealings with them are solely between you and them.
To the maximum extent permitted by law, the site is provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied. We do not warrant that the site will be uninterrupted, error-free, secure, or free of viruses or other harmful components, or that any information on it is complete, accurate or current.
Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred on you by the Australian Consumer Law or any other law that cannot lawfully be excluded or limited. Where our liability for a failure to comply with such a guarantee can be limited, our liability is limited, at our option, to re-supplying the relevant services or paying the cost of having them re-supplied.
Subject to your rights in section 10, and to the maximum extent permitted by law, we will not be liable for any indirect, incidental, special or consequential loss, or for any loss of profits, revenue, goodwill or data, arising out of or in connection with your use of, or inability to use, the site — whether in contract, tort (including negligence) or otherwise. To the extent we are liable and that liability can be limited, our total liability is limited to AUD $100.
To the extent permitted by law, you agree to indemnify us against any claims, liabilities, costs and expenses (including reasonable legal costs) arising from your breach of these terms or your misuse of the site, except to the extent caused by our own negligence or wrongful act.
We handle personal information in accordance with our Privacy Policy, which forms part of these terms. Please read it to understand how we collect, use and protect your information.
We may change, suspend or discontinue the site (or any part of it) at any time without notice. We may also update these terms from time to time; the current version will always be posted on this page with its “last updated” date. Your continued use of the site after a change means you accept the updated terms. We may restrict or terminate your access if you breach these terms.
These terms are governed by the laws of New South Wales, Australia. You and we submit to the non-exclusive jurisdiction of the courts of New South Wales and the courts that hear appeals from them.
If any provision of these terms is found to be invalid or unenforceable, it will be severed and the remaining provisions will continue in force. A failure by us to enforce any provision is not a waiver of it. These terms are the entire agreement between you and us in relation to the site.
